1.Scope

1.1 These Terms & Conditions apply to all contracts concluded between you (the consumer or business client) and Santiago Montenegro Perini (santiagomonteper.com) for the purchase of digital products and services, including but not limited to LUTs, PowerGrades, online courses, and personalized consulting sessions.

1.2 A “consumer” is any natural person who enters into a legal transaction predominantly for purposes outside their trade or profession. A “business client” is any individual or legal entity acting within their commercial or professional activity.

1.3 Each purchase grants a single-user license unless explicitly stated otherwise. Redistribution, resale, sublicensing, or multi-user access without written authorization is strictly prohibited.

3.Formation of the Contract

3.1 Product listings on santiagomonteper.com constitute an invitation to place an order, not a legally binding offer.
3.2 By clicking the “Purchase” or “Buy Now” button, you submit a binding offer. A contract is formed once you receive an order confirmation email.
3.3 In case of technical errors, pricing mistakes, or system failures, we reserve the right to cancel the order and refund any payments received.

4.Digital Products & Services

4.1 No Refund Policy for Digital Products. Due to the nature of digital content (LUTs, PowerGrades, downloadable assets, and online course materials), all sales are final. Once the product has been delivered or access has been granted, the right of withdrawal does not apply.

4.2 Compatibility

LUTs and PowerGrades are designed primarily for DaVinci Resolve (but are not exclusive). Certain features may require DaVinci Resolve Studio. It is the responsibility of the customer to verify software compatibility prior to purchase.

4.3 Online Courses

Course access is granted to one individual only and is non-transferable. Sharing login credentials, screen recording, redistribution, or uploading course materials to third-party platforms is strictly prohibited.

4.4 Personalized Consulting

Consulting sessions are delivered remotely via video conference unless otherwise agreed. Rescheduling requires at least 24 hours notice. Missed sessions without prior notice are considered delivered and non-refundable.

5.License Grant

5.1 Upon full payment, you are granted a non-exclusive, non-transferable, non-sublicensable license to use the purchased digital products.

5.2 You may use LUTs and PowerGrades in unlimited personal and commercial projects, including client work.

5.3 You may not:

• Resell, redistribute, or share the files
• Include the files in other digital products
• Make them available in public repositories
• Claim authorship of the original digital asset

5.4 The license is granted to a single individual. Studio-wide or enterprise licenses require a separate agreement.

6.Pricing & Payment

6.1 Prices displayed are final prices. VAT or applicable taxes will be calculated according to your country of residence where legally required.

6.2 Payments may be processed via third-party providers such as PayPal, Visa, Mastercard, or other payment gateways integrated into the website.

7.Intellectual Property

All digital products, educational content, branding, and materials remain the intellectual property of Santiago Montenegro Perini unless explicitly stated otherwise.

Purchasing a product does not transfer ownership. It grants a limited license for use.


8.Limitation of Liability

8.1 We do not guarantee compatibility with every hardware, operating system, or software configuration beyond what is stated.

8.2 Liability is limited to the amount paid for the product or service in question.

8.3 We are not liable for indirect damages, loss of profits, business interruption, or data loss.

9.Governing Law

These Terms shall be governed by the laws of Colombia.

For the EU and EE.UU consumers, mandatory consumer protection laws of their country of residence remain unaffected.

10.Severability

If any provision is deemed invalid, the remaining provisions remain fully enforceable.
